Have a Texas attorney familiar with travel businesses review and finalize this packet before sending it to travelers. Review the liability release, cancellation rules, consumer protections, privacy practices, and requirements in each destination and traveler jurisdiction. This agreement is between the traveler named above and Merit Events LLC DBA Lieux Secrets (we or us). The traveler is referred to as you. Each adult electronically signs for themselves; a payer or group leader does not sign away another adult’s rights.

1 Your booked services

Your booking confirmation and dated itinerary identify the services we arrange, the providers, the package price, occupancy, inclusions, and exclusions. Only expressly listed services are included. Flights, travel insurance, meals not listed, tips, personal purchases, and optional excursions are excluded unless your confirmation expressly includes them. An all inclusive description applies only to the listed meals, drinks, services, and hours; it does not mean every expense is covered.

2 Price and payment schedule

The price and payment schedule provided with your booking confirmation is part of this agreement. We will disclose fees, taxes, currency, and payment deadlines before acceptance. A payment plan divides the package price into installments; it does not change the cancellation policy. Price changes after acceptance require your written agreement, unless already expressly disclosed and permitted by law.

3 Booking confirmation and late payments

A request or payment alone does not confirm supplier availability. We will issue written confirmation or explain the options if we cannot confirm the requested services. If a payment is late, we will give written notice and the cure period below before canceling, unless a clearly disclosed supplier deadline requires earlier action. Cancellation charges then follow the attached schedule; late payment does not automatically forfeit every payment.

4 Your cancellation and refund acknowledgment

Send cancellation requests to the booking email in your confirmation. We will acknowledge receipt in writing and use the receipt date to apply the completed cancellation schedule. Refund eligibility follows that schedule and applicable law. Supplier charges, our disclosed fees, and any nonrefundable deposit must be identified before booking. No blanket no refund rule is created by this form.

Payments are credited against cancellation charges; charges will not be collected twice for the same loss. Any promised credits must state their value, expiration, and restrictions. Illness, visa refusal, personal emergencies, or missed flights do not automatically create a refund outside the completed policy or legal requirements. Insurance claims are decided by the insurer.

5 If we cancel or materially change the trip

If we cancel for a reason within our control, including failure to reach a disclosed minimum group size, we will refund payments to us for the canceled package. Separately purchased flights and services follow their own terms. If a material change is proposed, we will explain the alternatives and applicable refund rights; we will not impose materially different services without addressing your options.

6 Disruptions outside reasonable control

Severe weather, natural disasters, government restrictions, transport disruption, strikes, illness outbreaks, and supplier failures may require changes, postponement, or cancellation. We will communicate available alternatives and itemize any proposed nonrecoverable costs. We will return amounts refundable under applicable law and the booking terms and pass through supplier refunds attributable to your booking when received. Extra costs require disclosure and, where practical, agreement before being incurred. This clause does not excuse our own actionable misconduct.

7 Independent suppliers

Hotels, airlines, transport companies, excursion operators, restaurants, and other providers may be independent businesses responsible for their services. We arrange the listed services and perform our own agreed duties. Supplier terms must be provided or clearly linked before booking where relevant. Identifying a provider as independent does not eliminate duties the law imposes on us or responsibility for our own acts.

8 Travel documents and entry requirements

You must obtain a valid passport, required visas or transit permissions, and legally required health documents, and verify current entry rules for your nationality and route with official authorities. Check names on all reservations promptly. Notify us of errors. Boarding or entry decisions are made by authorities and carriers; resulting missed services follow the agreed cancellation terms and applicable law.

9 Departures and free time

Arrive at the stated meeting place before the published departure time. Unless we direct otherwise, scheduled transport and activities may depart without a late traveler. Contact the trip leader immediately if delayed. Reasonable replacement transport and rejoining costs caused by your lateness are your responsibility. If our mistake causes a missed service, we will address it under our obligations. Free time and independently arranged activities are your responsibility; we do not provide continuous supervision.

10 Conduct and removal

Follow local laws, supplier safety rules, and reasonable trip instructions. Harassment, threats, violence, illegal acts, or behavior that seriously endangers others may lead to removal from an activity or the trip. We will give a warning and opportunity to correct behavior where practical; an immediate safety threat may require immediate action. We will explain the reason, help identify safe onward options where practical, and apply the agreed refund terms and applicable law to unused services. You are responsible for documented damage and reasonable additional costs you cause; removal is not automatic forfeiture of every unused payment.

11 Access needs and personal responsibility

Tell us about accommodation, dietary, and access requests early so we can assess arrangements with suppliers. We cannot guarantee an accommodation until confirmed. Ask your clinician about fitness for planned activities. Keep medication and essential documents accessible. Avoid intoxication that compromises safety, and follow local alcohol laws. We do not provide medical diagnosis or personal medical supervision.

12 Notices and legal rights

Booking notices go to the email in your confirmation; update us when it changes. Report a service problem promptly so we can try to resolve it. This reporting request does not shorten legal claim deadlines. Texas law governs to the extent permitted, without displacing mandatory protections of another applicable jurisdiction. No arbitration, jury waiver, or exclusive court venue is imposed here. Nothing waives nonwaivable consumer rights, valid payment disputes, or claims outside the express scope of Form 2. If a provision is unenforceable, the remaining valid provisions continue. Changes to this agreement require written agreement; the trip attachment controls specific price and itinerary details, subject to mandatory law.

This packet is completed and executed electronically using electronic signatures only. By electronically signing, I consent to electronic records and signatures for this booking and intend my electronic signature to authenticate my agreement. I will receive a copy I can download or retain. The signing date is entered electronically or recorded by the signing platform. Consent for this booking does not waive any legal right to refuse electronic transactions in the future. My signature on Form 1 does not supply media consent or sign the separate liability release.

Read both pages before signing. This form contains a release of certain negligence claims. It is separate from the booking terms and does not replace an excursion operator’s own safety briefing or required forms.

1 Activities covered

This form applies to the services and activities identified in the signed itinerary and trip acknowledgment, including arranged road and boat transfers, tours, and any specifically listed excursions. An activity added later with materially different risks requires a separate acknowledgment before participation. Do not treat an activity absent from the supplied itinerary or activity description as automatically covered.

2 Travel and transportation risks

Travel can involve traffic accidents, unsafe or unfamiliar road conditions, breakdowns, sudden stops, boarding falls, boat instability, drowning, theft, illness, food or water contamination, heat, severe weather, civil disruption, delayed rescue, and differences in medical facilities. Belongings may be lost or damaged. Transport may be operated by independent suppliers. Follow seat belt, life jacket, and operator instructions and report apparent safety concerns.

3 Excursion risks

Where included in the signed trip acknowledgment, swimming and snorkeling involve currents, marine life, drowning, and equipment problems; yacht trips involve slips, collisions, and changing sea conditions; hiking involves falls, terrain, and exertion; animal encounters involve bites, kicks, or unpredictable behavior; and motorized activities involve collision, rollover, and injury. These examples do not fully describe every risk. The operator must explain activity specific restrictions, equipment, and local hazards before participation.

4 Alcohol and nightlife

Alcohol and nightlife can increase risks of impaired judgment, falls, assault, road injury, and separation from the group. I will follow local age limits and laws, keep track of my return arrangements, and not participate in driving, boating, swimming, or another unsafe activity while impaired. I remain responsible for my consumption and decisions.

5 Voluntary participation and safety

I may decline an optional activity or stop participating if I feel unsafe. Refunds for a declined activity follow the disclosed booking terms and applicable law. I will follow safety instructions, use required equipment, describe relevant limitations to the operator, and avoid activity beyond my ability. I understand that staff are not guaranteeing my safety. I may ask questions before agreeing.

6 Assumption of identified risks

I voluntarily accept the inherent risks described on page 1 and in the signed trip and activity attachments, including risks of serious injury, illness, death, and property loss, to the extent permitted by law. This acknowledgment does not mean I accept misconduct excluded below.

7 Release of ordinary negligence claims

TO THE EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE MERIT EVENTS LLC DBA LIEUX SECRETS, AND ITS OWNERS, EMPLOYEES, AND TRIP STAFF ACTING WITHIN THEIR DUTIES (THE RELEASED PARTIES), FROM MY CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE IDENTIFIED TRIP SERVICES AND ACTIVITIES, INCLUDING CLAIMS CAUSED BY A RELEASED PARTY’S OWN ORDINARY NEGLIGENCE IN ARRANGING OR COORDINATING THOSE SERVICES OR ACTIVITIES.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESSNESS, INTENTIONAL MISCONDUCT, FRAUD, OR LIABILITY OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE WAIVED. IT DOES NOT RELEASE A THIRD PARTY SUPPLIER UNLESS THAT SUPPLIER IS THE SUBJECT OF A SEPARATE VALID AGREEMENT. IT DOES NOT CANCEL EXPRESS REFUND OR PERFORMANCE OBLIGATIONS IN FORM 1.

8 Limits of this agreement

This is an adult’s agreement for their own claims. It does not purport to bind a minor or independently waive rights belonging to other people. No duty to defend or indemnify the released parties is created. If a provision cannot be enforced, the remaining valid provisions continue only to the extent permitted by law. Applicable mandatory protections remain in force.

9 Understanding and signature

I understand that this form may limit my right to recover damages, including for the released parties’ ordinary negligence described above. I have read both pages and the trip attachments, received an opportunity to ask questions, and may seek independent advice before signing. I am at least 18 and sign voluntarily. I intend my electronic signature to authenticate this release and will receive a retainable electronic copy. The signing date is entered electronically or recorded by the signing platform.

This form collects only the traveler’s full legal name, signing date, and electronic signature. This form is not a medical clearance, power of attorney, or blanket authorization to make treatment decisions. Adult travelers complete it themselves.

Emergency assistance authorization

If I need urgent assistance, I authorize Lieux Secrets staff to contact emergency services, and reasonably coordinate assistance or transport. When I can decide, my treatment decisions remain mine. If I cannot communicate, clinicians and any legally authorized decision maker determine care under applicable law. This form does not guarantee that a foreign provider will recognize an authorization.

I authorize sharing the minimum relevant information from this form with emergency responders, treating providers, and an insurer or assistance service as reasonably needed for the emergency. I am responsible for expenses legally chargeable to me and not paid by insurance; this does not shift expenses caused by Lieux Secrets’ legally actionable conduct to me.

Merit Events LLC DBA Lieux Secrets will limit access to emergency-related information to personnel who need it and handle it under the privacy notice supplied with the booking. This packet does not request medical history, medication details, or emergency contact details.

Lieux Secrets recommends considering coverage for trip cancellation and interruption, overseas medical care, emergency evacuation and repatriation, and planned activities. Insurance may be mandatory if your trip confirmation expressly requires it. Coverage, exclusions, purchase deadlines, and claims are governed by the insurer’s policy, not this acknowledgment.

Review geographic coverage, preexisting condition exclusions or waivers, activity restrictions, benefit limits, deductibles, and any cancel for any reason conditions. Your domestic health plan or credit card benefit may have limited overseas coverage. Do not assume a policy covers every cancellation or excursion.

If I decline optional coverage or travel before required coverage is in force, I understand I may have to pay covered types of losses myself, including cancellation charges, medical expenses, evacuation, or replacement travel. This does not release Lieux Secrets from its own legal duties. Declining insurance does not override an express insurance requirement; we will address eligibility under the booking terms.

Traveler confirmation

I understand that Lieux Secrets is not promising coverage, approving claims, or giving a medical opinion through this form. I will direct policy questions to the insurer or an appropriately licensed insurance professional. I understand the emergency authorization on page 1 and the financial risks of traveling without suitable insurance. Signing this form does not state that I have purchased or declined a policy.

By signing, I acknowledge the emergency assistance terms on page 1, authorize the limited emergency coordination and disclosures described there, and acknowledge the insurance risks described in this form.

Media consent is optional and does not affect booking eligibility or service quality. Signing this separate form grants the permission described below. If you do not consent, leave this form unsigned. An unsigned media release is treated as no promotional consent. No checkbox or explanation is required.

Scope of permission when signed

I authorize Merit Events LLC DBA Lieux Secrets and its contracted photographers, videographers, and marketing service providers to record my image and voice during this identified trip and use approved trip content on Lieux Secrets’ website, social accounts, email marketing, printed promotions, and paid advertisements. Use may be worldwide because online channels are accessible internationally. Service providers may use content only for Lieux Secrets’ authorized purposes; this is not permission to sell it for unrelated uses.

Editing and personal details

Reasonable cropping, captions, and editing are allowed, but content may not falsely imply my endorsement of an unrelated product or portray me in a misleading, defamatory, or sensitive context. This release does not authorize face swapping, synthetic voice cloning, or training an AI model on my likeness. My contact information, passport details, medical information, and room number may not be published under this release.

Compensation and duration

Unless a separate written creator or ambassador agreement provides otherwise, no fee or royalty is payable for this permitted use. Permission continues until withdrawn as described below. It does not transfer my identity or waive claims arising from misuse beyond this permission.

Declining or withdrawing permission

I may withdraw permission by writing to the booking or privacy contact in my confirmation. Lieux Secrets will stop new promotional uses after processing the request and make reasonable efforts to remove controlled online copies within 30 days, subject to applicable law. Already distributed printed materials and third party reposts may not be recoverable. If I decline, staff will make reasonable efforts to avoid intentional identifiable filming and publishing, and review group footage before promotional use. Other travelers’ personal recordings cannot be guaranteed; I can alert staff to a concern.

By electronically signing this separate form, I voluntarily grant the media permission described above and understand the scope and withdrawal process.

The itinerary and supplier information supplied with the booking identify scheduled activities and providers. Relevant safety restrictions, age limits, equipment requirements, and supplier forms must be supplied before participation. This form requires no activity selections or fill-in details.

Final acknowledgment

I have received the identified itinerary, inclusions and exclusions, completed payment and cancellation schedules, and relevant supplier restrictions. I understand which activities are optional. A materially different activity or material booking change will be explained before acceptance. This attachment supplements Forms 1 and 2 without expanding their release beyond their express terms. Destination entry advice must be checked against current official rules for my nationality and route.

Room assignments and expectations

A requested roommate or bedding arrangement is confirmed only when Lieux Secrets provides written confirmation. Assigned roommates will be told the arrangement before accepting it. Respect personal space, reasonable quiet hours, belongings, hygiene, and shared bathroom use. Do not permit unregistered overnight guests or share room access without the roommate’s consent and hotel approval. Follow hotel policies and do not harass or threaten another guest.

If a roommate cancels

Cancellation can change room availability and the occupancy rate. Lieux Secrets will explain available choices, such as a mutually acceptable replacement, an available shared room, or an available single room and its disclosed supplement. A remaining traveler is not automatically charged an unspecified supplement or the other traveler’s unpaid balance. If no suitable option is available, the organizer will explain cancellation and refund options under the booking terms and applicable law.

Room changes and disagreements

Notify the trip leader privately about a serious room concern. We will assess practical alternatives with the hotel. Changes depend on availability. Additional costs require disclosure and agreement before a voluntary change. A safety concern will be addressed promptly; this agreement does not require continued exposure to harassment or an unsafe roommate.

Hotel charges and damage

Personal charges belong to the traveler who incurs them. Responsibility for damage must be based on documented facts and applicable law; it is not automatically split equally. The hotel may require its own deposit or card guarantee. Keep valuables secure and do not use a roommate’s property without permission.

I accept the shared accommodation arrangement and completed cost rules above. If two travelers are sharing, each electronically signs their own copy.

Use only if Lieux Secrets accepts minors for this trip. This form records permission through full legal names, signing dates, and electronic signatures; it is not a release of a child’s legal claims, a custody transfer, or a substitute for border, airline, destination, or medical authorization requirements. Permission and supervision

I state that I have legal authority to give this permission and that travel does not violate a custody order or other restriction. I authorize the named minor to travel on the attached itinerary with the accompanying adult designated in the trip arrangements. That adult remains responsible for supervision and compliance with age limits. Lieux Secrets does not provide childcare unless expressly agreed in writing. Activities requiring further permission or exceeding age restrictions may not be undertaken under this form alone.

Emergency assistance

I authorize staff to contact emergency services and coordinate assistance, and to disclose necessary information to responders and any person legally authorized to make decisions for the minor. Treatment consent and substitute decision authority must comply with applicable law and any separately executed medical authorization. This packet does not collect the minor’s medical details. Form 3 is not a substitute for any legally required minor medical authorization.
